German Man Sentenced for Buying Heroin on the Darkweb

A 38-year-old was sentenced at Rosenheim District Court to two years and ten months in prison for ordering heroin and cocaine on the darkweb.

The investigation, like many, began with a package seizure by German customs officials. Customs officials opened the package and found 40 grams of heroin and five grams of cocaine containing within it.

German law enforcement officers conducted a controlled delivery of the package at the defendant’s house. They arrested the package recipient after accepted the package. After arresting the 38-year-old, the police searched his house for additional drugs and proof of drug trafficking. They found no additional drugs or any signs of drug trafficking during their search.

At a hearing on October 26, 2020, the defendant admitted he had ordered drugs through a darkweb marketplace. He told the court that he had ordered them for personal use only. The prosecution agreed with the personal use claims by the 38-year-old.

During the sentencing hearing, the prosecution asked the court to consider that the defendant had ordered drugs on two additional occasions. They recommended a prison sentence of two years and ten months.

The defense attorney asked the court to take into account that the defendant was a first-time offender and that he had attempted to stop using drugs. He then asked the court to suspend his client’s sentence.

The presiding judge agreed with the defense attorney. He suspended the defendant’s sentence for two years. The 38-year-old will need to enter a substance abuse treatment center and take regular drug tests as a part of his suspended sentence.
